1. Acceptance of Terms

By accessing or using Ebizmarts POS services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Description of Service

Ebizmarts POS provides a cloud-connected point-of-sale application for iPad and Mac that integrates with Magento and Adobe Commerce platforms. The service includes the POS application, web dashboard, API integrations, and customer support.

3. Account Registration

You must create an account to use Ebizmarts POS. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

4. Subscription and Billing

Ebizmarts POS is offered on a subscription basis. Your subscription will automatically renew at the end of each billing period unless cancelled. Prices may change with 30 days notice. All fees are non-refundable except as required by law.

5. Free Trial

New accounts receive a 30-day free trial with full access to all features. No credit card is required during the trial period. At the end of the trial, you must subscribe to a paid plan to continue using the service.

6. Acceptable Use

You agree to use Ebizmarts POS only for lawful purposes and in accordance with these Terms. You must not use the service to process fraudulent transactions, violate any applicable laws, or infringe on the rights of others.

7. Data and Privacy

Your use of Ebizmarts POS is also governed by our Privacy Policy. We process customer and transaction data on your behalf as a data processor. You remain the data controller for all customer data processed through the POS.

8. Intellectual Property

Ebizmarts POS, including all software, designs, and documentation, is the intellectual property of Ebizmarts Corp. Your subscription grants you a limited, non-exclusive license to use the service. You may not copy, modify, or distribute the software.

9. Limitation of Liability

To the maximum extent permitted by law, Ebizmarts Corp. shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the service. Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

10. Termination

Either party may terminate the subscription at any time. Upon termination, your access to the service will cease. We will retain your data for 30 days after termination, after which it may be deleted.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the service. Continued use after changes constitutes acceptance of the updated Terms.
